in the case of:
The Golden Hegemony of Anhur [Claimant]
vs.
The Republic of Indiya [Defendant]
Application:
Claimant nation(s): The Golden Hegemony of Anhur
Defendant(s): The Republic of Indiya
Date(s) of alleged infractions: 1/7/2014 - present
Summary of facts and how this broke the law/rules or violated the Constitution: Indiya has harmed the region of Verustian Federation with his inaction as Minister of Immigration. In talking with the Recruiters, it has been found that Indiya has not contacted any of them nor given them any direction. The chief responsibility of the Minister of Immigration is to manage the recruiters, as well as serve as the main recruiter, which Indyia has also failed to do. It is believed that Indiya's failure to carry out his duties effectively has led to a decline in VF population. He bound himself to these duties when he submitted his candidacy for the position of Minister of Immigration, and has been reminded of these duties in a Telegram by The Black Hat Guy. By being unable or unwilling to carry out these tasks, Indyia has violated trust of the VF people and Section 3 of the VF Constitution.
Remedy/Remedies sought: The removal of Indyia from his position as Minister of Immigration and a special election be held for the position of Minister of Immigration or his resignation and appointment of a successor for the rest of the January Term.
The Minister of Justice has judged your application meritorious. Trial follows below.
Judgment
JENLOM, MoJ
1. The Golden Hegemony of Anhur, who is and was at all material times the Minister of Foreign Affairs, brought a case against The Republic of Indiya, who was the Minister of Immigration, alleging that through inaction and lack of adequate communication with members of the Region's recruiter pool, the defendant had failed to execute his duties as Minister of Immigration and thus harmed the interests of the region.
2. The defendant did submit some evidence to the contrary, although evidence from the Delegate suggested that his participation in government had been minimal. It is unclear to what degree the scarcity of action caused harm to the region.
3. At any rate, on 19 January 2014, Indiya moved his nation from the Versutian Federation to the North Pacific, thus violating section 1.6 of the Constitution of the Versutian Federation, which reads as follows:
4. "1.6. A candidate for election must have an active nation resident in the Versutian Federation for the duration of their term through which they will be contactable."
5. On Thursday, 2 January 2014, the Defendant signed an affidavit promising to uphold the Constitution of the Versutian Federation. It is the view of the court that he has failed to do so.
6. The Defendant also harassed the Claimant prior to his departure from the region, which makes his violation of the Constitution more aggregious.
Held: that the Defendant be removed from office immediately and that the office remain vacant for the remainder of this term, responsibility for recruitment in the meantime may be shared between other government ministers.
IT IS ORDERED the Defendant be removed from office.
