in the case of:
The Queendom of Marrigoldria [Claimant]
vs.
The United Socialist States of Kenche Gle [Defendant]
Application:
Claimant nation(s): The Queendom of Marrigoldrria
Defendant: The United Socialist States of Kenche Gle
Date(s) of alleged infractions: September 9, 2017, approx 5:51AM CST
Summary of facts and how this broke the law/rules or violated the Constitution: He said "autistic children should be eliminated so we won't have people like this" and then provided a gif with a child holding a paper sign and moving his arms about. This comment is malicious in nature and offensive to say the least. Article 8.2.1 and Article 8.2.2 have been violated.
Remedy/Remedies sought: Either a temporary server mute or server ban. Whichever the court deems appropriate.
I, The Queendom of Marrigoldrria, hereby certify the above to be correct to the best of my knowledge.
The Minister of Justice has judged your application meritorious. Trial transcript can be viewed here.
Judgement
ALAMEI, MINISTER OF JUSTICE:
1. Singling out a specific person as an example for why autism should be "eliminated" is a different beast than discussing remedies of the condition in an academic sense, particularly given the phrasing of "autistic children" being eliminated when the accompanying image is of a child who may or may have autism.
2. That said, while the comments made by the defendant were understandably offensive and in poor taste, as a singular occurrence they seem to betray a lapse in judgment more than active malice or griefing.
3. While the court maintains that this singular incident does not rise to the level of griefing, a more egregious example or a pattern of such behavior will not be given such clemency. It is my hope that this case will motivate Kenche Gle and others to be less callous with their words and more considerate of their fellow citizens.
4. In the future, it would be appreciated if testimony were given more promptly so that cases could be resolved in a more timely manner.
IT IS ORDERED that no punitive action be taken against the defendant.
